Welcome to the Haithamy App. By downloading, accessing, or using this application or the haithamy.com website (collectively, the "Service"), you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must discontinue use of the Service immediately.

1. About the App

The Haithamy App is a digital and AI-integrated repository of Shāfi'ī Jurisprudence (Fiqh). It serves as a smart reference library to help users search and navigate classical Islamic texts, including:

  • Tuḥfat al-Muḥtāj (10 volumes) by Sheikh Ibn Ḥajar al-Haytamī (RA).
  • Fatḥ al-Muʿīn by Sheikh Zaynuddin Makhdūm (RA).
  • Iʿānat al-Ṭālibīn, the prominent commentary on Fatḥ al-Muʿīn.

The Service uses Artificial Intelligence (currently Google Gemini and similar models) to facilitate semantic search, summarization, and translation across these texts.

2. AI Disclaimer — No Religious Rulings (Fatwa)

The Haithamy App is a digital library and search tool. It is not an "AI Ustaz", a Mufti, or a substitute for qualified scholars.

  • Artificial Intelligence is prone to errors, misinterpretations and hallucinations.
  • Search results, summaries and translations are provided strictly for reference and educational purposes.
  • No Fatwas. Users must not use this app to independently derive religious rulings. For practical religious guidance and definitive rulings, consult qualified and authentic Islamic scholars.
  • The developers and administrators hold no liability for any religious, personal, or legal action taken based on AI-generated output.

3. Eligibility and User Accounts

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to create an account. Users between 13 and 18 must obtain consent from a parent or guardian.

Strict prohibition on credential sharing. Your account is for your personal use only. You must not share your email and password with any other person or use multiple devices in a way that suggests credential sharing.

Consequences. If we detect or reasonably suspect credential sharing, sectarian-driven misuse, or other violations of these Terms, we may suspend the account pending investigation. We will notify you of any decision and provide a reasonable opportunity to appeal where local consumer law requires.

4. Acceptable Use and Code of Conduct

The Haithamy App is built on the sacred foundations of Islamic knowledge. While using the Service you must not:

  • Use content to incite hatred, sectarian conflict, or disrespect of Islamic Sharī'ah and recognised scholars.
  • Extract content to spread misinformation, fabricate rulings, or mock Islamic teachings.
  • Attempt to reverse-engineer, scrape at scale, or republish the digitised texts and translations.
  • Use the Service for illegal, harmful, or commercial purposes without written permission.

Violations may result in account suspension and, where the conduct is unlawful, legal action.

5. Subscription and Renewal

Premium features of the Haithamy App may be provided on a subscription basis. Subscription is processed outside the mobile app stores (web payment). The mobile app does not collect payment directly.

  • Current pricing is published on the website at the time of purchase or renewal.
  • We may change subscription prices from time to time. Any change to your existing subscription will be communicated to you in advance by email, and will only take effect at your next renewal. You may cancel before the new price takes effect.
  • Subscriptions do not auto-renew without an action on your part; you must pay each renewal cycle manually unless we expressly offer auto-renewal in writing.
  • Refunds are handled under applicable consumer law of your jurisdiction. Where local law does not require a refund, fees paid are non-refundable.

6. Account Deletion

You may delete your account at any time:

When you delete your account, your personal data (email, name, conversation history) is anonymised immediately and permanently purged within thirty (30) days, except where we are required to retain certain records by law.

7. Intellectual Property

All content within the Service — including the digital structuring of the texts, translations, app design, logos, AI prompt templates, and software code — is the intellectual property of the Haithamy team. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial, educational purposes only.

8. Service Availability and Updates

We strive to provide uninterrupted service but the Service may occasionally be unavailable for maintenance, updates, or unforeseen events. We may modify, suspend, or discontinue any feature without liability, although we will give reasonable notice of major discontinuations.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, the Haithamy team will not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of the Service. Our total aggregate liability is limited to the amount you have paid us in the twelve months preceding the claim.

10. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the Haithamy team is established, without regard to conflict-of-law principles. Disputes will first be attempted to be resolved amicably; failing that, they will be submitted to the competent courts of that jurisdiction. Nothing in this section limits your statutory consumer rights in your country of residence.

11. Amendments

We may update these Terms from time to time. Material changes will be notified by email or in-app banner at least seven (7) days before they take effect. Continued use of the Service after a change constitutes acceptance of the revised Terms.
